OXFORD TOWNSHIP
LAND USE BOARD MEETING
OCTOBER 3, 2005
Chairman Ischinger called the
meeting to order at 7:30 p.m.
ADEQUATE NOTICE was given as
follows: Notice was sent to the Star
Gazette and Express Times. Notice was posted on the
Municipal bulletin
Board in the Township Administration building in
Oxford Township,
New Jersey, and notice was filed with the Township
Clerk.
ROLL CALL:
Members Present: Mr. Ischinger, Dr. Yeager, Ms.
Smorzaniuk, Mayor Lazorisak,
Mr. Rosenberg, Ms. Accetturo, Ms. Ciaburri, Mr.
Dresser
Members Absent: Mr. Cratch, Mr. Calabrese
Also Present: Engineer M. Finelli, Attorney M.
Garofalo
COMMUNICATIONS: A list was
provided to the Land Use Board members.
MINUTES: A motion to approve the
minutes of the September 12, 2005 meeting
was made by Mr. Dresser, seconded by Ms. Accetturo,
Vote: Dresser, Accetturo,
Ischinger, Yeager, Smorzaniuk, Rosenberg, Ciaburri –
Ayes, 0 – Nay, Lazorisak –
Abstained, motion carried.
ZONING OFFICER’S REPORT: September
zoning report.
The September zoning report will be reviewed at the
November 14, 2005 meeting.
COMPLETENESS ITEMS:
1. Phillip & Donna Martin – Completeness review for
a Variance application
For Block 2, Lot 13.01 located at 200A Jonestown
Road. The applicant
proposed replacing an existing mobile home with the
construction of
a two story single family home. Engineer M. Finelli
reviewed his report
dated October 3, 2005. Mr. Finelli recommended the
applicant embellish
their application with additional zoning
information, the variances requested
should be shown, utility service shown and establish
relief. Mr. Finelli
suggested the applicant stop in his office and
discuss the additional
information required further. A motion to deem the
application incomplete
per the Engineer’s report of October 3, 2005 was
made by Mayor Lazorisak,
seconded by Ms. Smorzaniuk, all ayes motion carried.
DISCUSSION & PUBLIC HEARING ITEMS:
1. Vernon Pensyl – Public Hearing for a Variance
application
for Block 24, Lots 30 & 35 located at 175 Belvidere
Avenue.
The applicant did not appear and no action was taken
on this application.
2. Wall Street Partners LLC/ Samir
Elbassiouny – Public Hearing for a Site
Plan and Minor Subdivision application with Variance
relief for Block 6,
Lot 4 located on Wall Street.
The applicant was represented by Attorney Michael
Lavery and Engineer
Richard Pelizzoni. Engineer M. Finelli recommended
the application be
deemed complete and the applicant resolve some of
the issues prior to
the public hearing. A motion to deem the application
complete per the
Engineer’s report of October 3, 2005 was made by Mr.
Ischinger,
seconded by Mr. Rosenberg, all ayes motion carried.
This application
will be heard without further notice required on
November 14, 2005.
3. Organic Aggregates, Inc. –
Public Hearing for a Preliminary Site Plan
application for Block 26, Lot 87 located on Quarry
Road. Board member
Dr. Yeager stepped down for the application.
The applicant was represented by Attorney Donald
Morrow and Engineer
Theodore Bayer. Chairman Ischinger stated the
information had not
been delivered to Mr. Finelli until Friday and there
was not adequate
time for Mr. Finelli to review the information.
Engineer M. Finelli stated there was not adequate
time for a report.
Attorney M. Garofalo stated the Board would support
Mr. Finelli’s
decision and carry the application until the
November 14, 2005 meeting
without further notice being required. A motion to
carry the application
was made by Mayor Lazorisak, seconded by Mr.
Ischinger, all ayes
motion carried. Dr. Yeager returned to the Board at
this time.
4. John & Jacqueline Edmonds –
Public Hearing for a Minor Subdivision
application with Variance relief for Block 24, Lot
63 located at 111 Belvidere
Ave.,Oxford NJ. The applicant was represented by
Attorney Mary Iazzetta
and Engineer Pamela Matthews. Attorney M. Iazzetta
stated the applicant
proposed to subdivide the main lot 63 into two lots
and would be building
a ranch home on the new lot. Attorney M. Garofalo
swore in Engineer
Pamela Matthews, Ms. Matthews and applicant Mr. J.
Edmonds.
Ms. Matthews addressed issues brought up by Engineer
M. Finelli’s
initial technical review, pg. 5 - Ms. Matthews
addressed the additional
right of way with Warren County Engineers. Ms.
Matthews stated every
effort was made to purchase additional property a
letter was provided by
the adjacent property owners Mr. & Mrs. Tayburn. Ms.
Matthews stated
the applicants have agreed to relocate their shed as
requested.
Ms. Matthews stated there were no wetlands within
the vicinity.
Ms. Matthews stated a new site triangle was provided
in the plans per the
County standards. Mayor Lazorisak stated the
Township committee has
been splitting the unnamed alleys with the property
owners as they come up.
Engineer M. Finelli stated most of the lot should go
back to lot 70. Mayor
Lazorisak asked if the alley was dedicated would it
help the application.
Engineer M. Finelli stated this would probably not
help the application.
Mr. Finelli stated the site easement is as much a
county call as a township
call. Ms. Matthews stated the driveway would be
removed from Zulauf and
the one from Belvidere would be utilized. Ms.
Matthews stated spot elevations
and drywells have been added to the plans as
requested, and there would
be no water or sewer hook ups for the basement. Ms.
Matthews stated the
well and sewer services have been shown and all
utilities have been shown.
Approval boxes have been added and all items in the
letter were provided as
well. Attorney M. Garofalo reviewed the conditions
for approval and reminded
the applicant of the developer’s fee ordinance.
A motion to grant variance relief was made by Mayor
Lazorisak
seconded by Ms. Accetturo, all ayes motion carried.
A motion to grant
Minor Subdivision approval was made by Ms.
Smorzaniuk, seconded by
Mr. Ischinger, all ayes, motion carried.
PUBLIC COMMENT:
No public comment was offered.
MAYOR’S REPORT:
* Closing on the Quinzel property next week.
* Hissim property much further along then Quinzel.
* Hired environmentalists to satisfy NJ DEP for
active recreation requirement.
* State supplied funding, NOA still required.
* Contract negotiated and approved for Covanta, 20-
year agreement.
* 200k contribution for the Mt. Pisquah ball fields,
go ahead for plans granted.
VOUCHERS:
A motion to approve vouchers presented was made by
Mr. Rosenberg, seconded by
Ms. Accetturo, all ayes motion carried.
ADJOURNMENT: 9:05 p.m.
With no further business before the Board and no
public comment offered the
meeting was adjourned.
