SPECIAL MEETING
APRIL 7, 2008
 
The Committee of the Township of Oxford held a Special Meeting on April 7, 2008 in the Oxford Township Municipal Building, 11 Green Street, Oxford, New Jersey.
 
Mayor Riley announced that the meeting had been properly advertised in compliance with the OPMA of 1975 and called the meeting to order at 6:40 PM.
 
In attendance were Bonnie Riley, N. Angelo Accetturo, William Bray, and Sheila L. Oberly. 
 
Stuart Kellner, property owner of 50 Wall Street attended the meeting to discuss with the Committee the timeline of clean up on the Oxwall property.
 
Mr. Kellner stated that he had an Environmental Company walk the property and took approximately 50 samples to be tested for asbestos.  The samples were sent to a lab for analysis.   Mr. Kellner said that the report showed that the asbestos was limited to certain areas and other areas were free of asbestos.   At that time, he was hopeful that he would be able to cleanup the areas that are asbestos free.  The environmental company told him that nothing inside of the fence could be touched until all asbestos is removed from the area as per the New Jersey Environmental Protection Agency.  He stated that he has contacted a number of companies that do asbestos cleanup with prices varying over $100,000.  He said he has found a company a lot more reasonable and a meeting is scheduled with the EPA this week to talk about the approach and obtaining the necessary permits for the cleanup.  Mr. Kellner told the Committee that the office of EPA is out of Manhattan for Warren County.  He said he cannot go on the site and cannot cleanup this property until after the meeting next week with EPA, and at that time he would notify the Committee with more information and a timeline of cleanup.  Mr. Kellner said that the company he has a contract with for cleanup is located out of Union County.
 
Mr. Bray asked the name of the company that was hired and Mr. Kellner said he would not wish to give out that information as per advise of council.  He said, he does not have a written contract but a verbal contract and would have a written contract after this company meets with the EPA.  He stated, he would notify the Committee tomorrow with the name of the company.  
 
Mr. Accetturo asked that a report be given to the Committee next Monday or Tuesday of the result of the meeting.  Mr. Kellner said he would keep the Committee informed each step that is taken for this cleanup. 
 
Mr. Kellner said he would have no problem leveling the building but does not want to lose any imperious coverage.  He said that he would submit an architectural plan that would be economically successful for the Township and the investor.
 
Mrs. Riley stated that she would feel more comfortable if the Committee had a copy of this environmental report, and knew what company Mr. Keller is dealing with, just would like something solid to distribute to the public.  “Trust but Vertified.”
 
Mrs. Riley said that one of the Committee members should meet or have some correspondences with the EPA stating that Oxford Township is interested in any progress or information that is available.
 
Mr. Kellner suggested to wait until after this meeting takes place, let him get the feedback, share it with the Committee and then this should help the Committee decide what steps should be taken.
 
Mr. Accetturo thanked Mr. Kellner for attending the meeting and keeping it in public session.   He said he hopes to get through the progress and see something get done in the next couple months.
 
PUBLIC COMMENT
 
Joan Mulligan commented that if everything falls into place like Mr. Kellner stated; keep on top of the cleanup; keep communication open, the Township is on the right road and this has been a very successful meeting.
 
Mr. Kellner said that the initial things requested, he would give to the Committee next week, some information will take longer and some things he is not sure he will give the Township.
 
Mr. Bray asked for certain items:
 
A copy of the environmental report and the name of the environmental company: Mr. Kellner will call the Clerk tomorrow after consulting with his attorney and give her the information.
 
Survey of site and a calculation of the imperious coverage-Mr. Kellner will look into this immediately.
 
Mrs. Riley asked if we would have a report from the EPA meeting by Wednesday of next week April 16th -Mr. Kellner guaranteed it.
 
Mrs. May asked if the property on Wall Street was insured before the fire and if there is insurance now-Mr. Kellner stated No.
 
Mrs. Riley thanked Mr. Kellner for attending the meeting and sincerely hope we can work together in the future.
 
Short Recess
 
RESOLUTION 2008-42
 
Township of Oxford
Warren County, New Jersey
 
Tonnage Grant Application (2007)
 
WHEREAS,  the Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102, has established a recycling fund from which tonnage grant may be made to municipalities in order to encourage local source separation and recycling programs; and
           
WHEREAS,  it is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grant to develop new municipal recycling programs and to continue and to expand existing programs; and
 
WHEREAS,  the New Jersey Department of Environmental Protection and Energy is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act; and
 
WHEREAS,  the Recycling regulations imposes on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and
 
WHEREAS,  a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment to this municipality to recycling and to indicate the assent of the Committee of the Township of Oxford to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and
 
WHEREAS,  such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.
 
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Oxford hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protections and Energy and designates Bonnie Riley, Recycling Coordinator, to ensure that the application is properly filed; and
 
BE IT FURTHER RESOLVED that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to be used solely for the purpose of recycling and promoting recycling in the township.
 
 
On motion by Mr. Accetturo, seconded by Mr. Bray and passed unanimously on roll call vote to adopt Resolution 2008-42 2007 Tonnage Grant Application.
 
RESOLUTION 2008-43
 
 
 
WHEREAS, Bill A289 (Grace’s Law) is currently being considered by the Assembly Appropriations Committee; and
 
WHEREAS, Bill A289 provides for Hearing Aid Insurance Legislation, which is vital to many residents of New Jersey and especially to the Gleba family of Washington Borough, County of Warren, State of New Jersey; and
 
WHEREAS, the passing of this bill would provide insurance coverage for hearing aids for children fifteen years of age and younger; and
 
NOW THEREFORE BE IT RESOLVED, by the Mayor and Committee of the Township of Oxford, County of Warren and State of New Jersey, that we support the adoption of A-289; and
 
BE IT FURTHER RESOLVED, that a copy of this Resolution be forwarded to all Municipalities in Warren County seeking their support for Bill A-289, as well as copies to the members of the Assembly Appropriations Committee and the sponsors of this bill, Assemblymen Roberts, Cohen, and Bateman.
 
On motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll call vote to adopt Resolution 2008-43 Grace’s Law.
 
On motion by Mr. Accetturo, seconded by Mr. Bray and passed on roll call vote to authorize the Mayor to sign the Pre-Disaster Mitigation Plan.
 
Mr. Bray stated that he walked the Connolly Farm on Oram’s Lane and took photographs, which he would e-mail, to the Clerk, for discussion at the Township meeting on April 16, 2008.
 
Mr. Accetturo read the letter from the Warren County Mosquito Commission notifying the Township of ariel spraying of Cat Swamp on April 8th, 9th, and 10th from 6:00 AM to 4:00 PM.
 
On motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll all vote to adjourn the meeting at 7:45 PM.
