WORKSHOP MEETING
JULY 1, 2008

The regular scheduled workshop meeting of the Mayor and Committee of the Township of Oxford was held on July 1, 2008 in the Township Municipal Building, 11 Green Street, Oxford, New Jersey.

Mrs. Riley announced that the meeting had been properly advertised in compliance with the OPMA of 1975 and called the meeting to order at 6:12 PM.

In attendance were Bonnie Riley, N. Angelo Accetturo, William Bray, and Sheila L. Oberly.

Ordinance 2008-06 Fixing the Salary Ranges for Certain Employees was read by title on second reading and opened for public comments. There being no public comments, the comment period was closed. On motion by Mrs. Riley, seconded by Mr. Accetturo and passed unanimously on roll call vote, Ordinance 2008-06 was approved.

Ordinance 2008-09_Recycling, introduction, first reading was tabled until July 16, 2008.

RESOLUTION
2008-60
RESOLUTION OF THE TOWNSHIP COMMITTEE OF
THE TOWNSHIP OF OXFORD APPROVING LIQUOR
LICENSES FOR THE PERIOD OF JULY 1, 2008 TO
JUNE 30, 2009 FOR THE FOLLOWING LICENSE

WHEREAS, the liquor license noted below require approval for the period July 1, 2008 to June 30, 2009.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Oxford that the following liquor license be and hereby are approved for the period July 1, 2008 to June 30, 2009.

On motion by Mr. Accetturo, seconded by Mrs. Riley and passed unanimously on roll call vote, to approve Resolution 2008-60.

GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT
RESOLUTION 2008-61

WHEREAS, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year 2007 has been filed by a Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A: 5-6, and a copy has been received by each member of the governing body; and
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations; and

WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations, as evidenced by the group affidavit form of the governing body attached hereto; and

WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:
R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon con¬viction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.

NOW, THEREFORE BE IT RESOLVED, That the Oxford Township Committee of the Township of Oxford, hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

On motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll call vote, to adopt Resolution 2008-61.

RESOLUTION 2008-63

APPOINTMENT OF TAX ASSESSOR

WHEREAS, the Committee of Oxford Township did meet on July 1, 2008 and voted on appointing Rich Motyka to the position of Tax Assessor for the Township of Oxford:

NOW, THEREFORE BE IT RESOLVED by the Oxford Township Committee of Oxford Township that Rich Motyka be approved for a four year appointment for the position of Tax Assessor under Title 54:1-35.31&32 from July 1, 2008 to June 30, 2012.

On motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll call vote to adopt Resolution 2008-63.

On motion by Mr. Accetturo, seconded by Mrs. Riley and passed unanimously on roll call vote to approve the Special One Day Liquor License permit for the Oxford Volunteer Fire Company for the Oxford Summer Festival to be held on August 9, 2008. (Rain date August 10, 2008).

On motion by Mr. Accetturo, seconded by Mrs. Riley and passed unanimously on roll call vote to approve the 50/50 Raffle for the Oxford Central School PTO to be held on May 1, 2009.

Mr. Bray reviewed the JCP&L bill and questioned the cost Oxford Township is being charged for streetlights. Mrs. Riley stated that she would get in touch with Hannah Massaquoi, Area Manager of First Energy. She will report back to the Committee at the next Township meeting.

Mrs. Riley said that she spoke to Charles Herring, Regional Supervisor of Office of Local Code Enforcement in Asbury, NJ - Department of Community Affairs about the Oxwall site. He said, Carl Gross, inspector will get in touch with Mr. Kellner, owner of Oxwall, to notify him that he would like to get inside the fence to inspect the property.

The Committee discussed the draft copy ordinance given to the Committee from Mike Lavery in reference to the Basic Property Maintenance Code for Oxford Township.

ORDINANCE 2008-10

AN ORDINANCE OF THE TOWNSHIP OF OXFORD,
COUNTY OF WARREN, STATE OF NEW JERSEY,
AMENDING AND SPPLEMENTING THE GENERAL
ORDINANCES OF THE CHAPTER _____
“BOCA BASIC PROPERTY MAINTENANCE CODE”

BE IT ORDAINED by the Township Committee of the Township of Oxford

SECTION I

FINDINGS:

The Township Committee of the Township of Oxford finds and determines:

1. that building conditions of the character described in N.J.SA. 40:48-2.3 and N.J.S.A. 40:48-2.3a and in Resolution __________ exist in the Township;

2. that it is appropriate to adopt an ordinance relating to such buildings which are unfit for human habitation or occupancy or use;

3. that the adoption of this ordinance will promote the public health and safety within the Township of Oxford.

SECTION II

DEFINITIONS:

The following terms shall have the meanings ascribed to them by N.J.S.A. 40:48-2.4 which is hereby incorporated herein by reference: “public officer”, “Public authority,” “owner”, “parties in interest,” “building.”

SECTION III

PUBLIC OFFICER DESIGNATED:

The Construction Official of the Township is hereby designated and appointed to exercise the powers prescribed by this ordinance and by N.J.S.A. 40:48-2.3 and N.J.S.A. 40:48-2.3a. In appropriate cases another public officer may be designated by Resolution of Township Committee.

SECTION IV

COMPLAINT, NOTICE AND HEARING:

Upon the filing with the Construction Official of a petition by a public authority or by at least five residents of the Township charging that any building is unfit for human habitation or occupancy or use or whenever it appears to the Construction Official (on his own motion) that any building is unfit for human habitation or occupancy or use, the Construction Official shall, if his preliminary investigation discloses a basis for such charges, issue and cause to be served upon the owner of and parties in interest in such building a complaint stating the charges in that respect and containing a notice that a hearing will be held before the Construction Official or other designated person at a place therein fixed not less than seven (7) days or more than thirty (30) days after the serving of said complaint that the owner and parties in interest shall be given the right to file an answer to the complaint and to appear in person, or otherwise, and give testimony at the place and time fixed in the complaint

SECTION V

STANDARDS TO BE APPLIED:

In proceedings under this ordinance the Construction Official or other designated public officer may determine that a building is unfit for human habitation or occupancy or use if he finds that conditions exist in such building which are dangerous or injurious to the health or safety of the occupants of such building, the occupants of neighboring buildings or other residents or such municipality; such conditions shall be deemed to include the following (without limiting the generality of the foregoing): defects therein increasing the hazards of fire, accident, or other calamities; lack of adequate ventilation, light, or sanitary facilities; dilapidation; disrepair, structural defects; uncleanliness; failure to comply with the requirements of the building code or the certificate of occupancy; further ordinances may provide additional standards to guide the public officer, or his agents, in determining the fitness of a building for human habitation or occupancy or use.

SECTION VI

FINDINGS REQUIRED, SERVICE:

If, after said notice and hearing, the Construction Official determines that the building is unfit for human habitation or occupancy or use, he shall state in writing his findings of fact in support of such determination and shall issue and caused to be served upon the owner and parties in interest an order:

(1) requiring the repair, alteration or improvement of the said building to be made by the owner, within a reasonable time, which time shall be set forth in the order or at the option of the owner to vacate or have the said building vacated and closed within the time set forth in the order; and

(2) if the building is in such a condition as to make it dangerous to the health and safety of persons on or near the premises, and the owner fails to repair, alter or improve the said building within the time specified in the order, then the owner shall be required to remove or demolish the said building within a reasonable time as specified in the said order of removal.

SECTION VII

ORDER TO BE ISSUED:

If the owner fails to comply with the order to repair, alter or improve, or, at the option of the owner, to vacate and close the building, the Construction Official a) may cause the building to be repaired, altered or improved, or to be vacated and closed, and b) cause to be posted on the main entrance of the building a placard with the following words:

“This building is unfit for human habitation or occupancy or use; the use or occupation of this building is prohibited and unlawful.”

SECTION VIII

PUBLIC OFFICER AUTHORIZED TO ACT

If the owner fails to comply with an order to remove or demolish the building, the Construction Official may cause such building to be removed or demolished or may contract for the removal or demolition thereof after advertisement for, and receipt of, bids therefor.

SECTION IX

OVERSIGHT:

A copy of any complaint issued pursuant to section 4 of this ordinance shall be sent to the Township Committee and any order entered pursuant to section 4 hereof and notice of any action taken by the Construction Official pursuant to section 7 and 8 hereof shall be sent to the Township Committee.

SECTION X

RECOVERY OF COSTS; LIEN:

The procedures for recovery of the costs of proceedings undertaken pursuant to this ordinance and the cost of repairs, alterations or improvements or of vacating and closing or removal or demolition of said building and the procedures for handling the sale of materials of said building shall be those set forth in N.J.S.A. 40:48-2.5 which are incorporated herein by reference.

The foregoing ordinance was passed on first reading at a meeting of the Township Committee held on the 1st day of July 2008 in the Township Municipal Building, 11 Green Street, Oxford, New Jersey.

Second Reading, Public Hearing will be held on the 5th of August 5, 2008 at or near 6:00 PM in the Oxford Township Municipal Building, 11 Green Street, Oxford, New Jersey.

On motion by Mr. Accetturo, and seconded by Mr. Bray to introduce Ordinance 2008-10 “BOCA Basic Property Maintenance Code.” Mrs. Riley abstained.


On motion by Mr. Bray, seconded by Mr. Accetturo to pay all the vouchers listed on the June 2008 Bill List except the following bill which Mrs. Riley withheld; PCFA-$787.60.


On motion by Mr. Bray and seconded by Mr. Accetturo to rescind Ordinance 2008-10 BOCA Basic Property Maintenance Code.” Mrs. Riley abstained.

On motion by Mr. Bray and seconded by Mr. Accetturo for a resolution that hereby resolve that there exists in the Township of Oxford buildings that would meet the definition standard found in NJAC 40:48-2.3 to 40:48-2.3a, that therefore they are unfit for human habitation or occupancy or use. Mrs. Riley abstained.

On motion by Mr. Bray and seconded by Mr. Accetturo to introduce Ordinance 2008-10 BOCA Basic Property Maintenance Code.” Mrs. Riley abstained.

Mr. Bray distributed to the Committee, a list of businesses for the business zone. He incorporated the existing businesses listed in the B zone and the existing businesses on the street currently. He also included, is in his opinion, other acceptable list of businesses.

EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meeting Act, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances, and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

1. The public shall be excluded from the discussion of any action upon the hereinafter-specific subject matter.

2. The general nature of the subject matter to be discussed is: two contractual matters (shared court and PBA Contract) and salaries for 2008.

3. It is anticipated at this time that the above stated subject matter will be made public at the conclusion of the litigation. The motion carried with the following roll call vote.

On motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll call vote to enter into Executive session at 8:25 PM.

Entered into open session at 9:45 PM on motion by Mr. Bray, seconded by Mr. Accetturo and passed unanimously on roll call vote. No Official Action was taken.

Mrs. Riley stated that she found two people that are licensed as a Sanitary Sewer Licensed Operator- a requirement from NJDEP for every Township. Mrs. Riley said that Art Groves charges $7,000.00 a year and the gentleman from Belvidere charges $7,200.00 a year. The Committee will discuss this appointment at the next Township meeting after Mr. Bray and Mr. Accetturo research other options on how to fill this position.

On motion by Mr. Accetturo and seconded by Mrs. Riley to adopt Resolution 2008-62 Fixing Salaries of the Employees of Oxford Township. Mr. Bray voted No.

On motion by Mr. Accetturo and seconded by Mr. Bray and passed unanimously on roll call vote to adjourn the meeting at 10:15 PM.
