WORKSHOP MEETING
SEPTEMBER 2, 2008
The regular scheduled workshop meeting of the
Mayor and Committee of the Township of Oxford
was held on September 2, 2008 in the Township
Municipal Building, 11 Green Street, Oxford, New
Jersey.
Mrs. Riley announced that the meeting had been
properly advertised in compliance with the OPMA
of 1975 and called the meeting to order at 6:10
PM.
In attendance were Bonnie Riley, N. Angelo
Accetturo, and Sheila L. Oberly. Mr. Bray was
absent.
RESOLUTION 2008-73
REFUNDING OVERPAY
WHEREAS, Block 34, Lot 3 at 100 Oxford Ave owned
by John H Corson, Jr., otherwise known as Valley
View Estates was reduced in value from
$2,964,100.00 to $2,400,000.00 as a result of a
state tax appeal for the year 2007, there is now
a resulting overpay of $12,692.25; and
WHEREAS, Mr. Corson has requested through his
attorney that instead of a credit to his taxes,
a check be issued to he and his attorney
jointly; and
WHEREAS, he has waived interest on the judgment
provided the tax refund is paid within 60 days
of the date of entry of the tax court judgment;
NOW, THEREFORE BE IT RESOLVED by the Mayor and
Township Committee of the Township of Oxford on
this 2nd day of September that the Chief
Financial Officer be authorized to draw a check
payable to “John H Corson, Jr. and. Stuart C.
Ours, Esq.” in the amount of $12,692.25. Such
check may be mailed to Mr. Ours at PO Box 308,
Washington, NJ 07882-0308.
On motion by Mr. Accetturo and seconded by Mrs.
Riley Resolution 2008-73 Refunding Overpay was
approved.
RESOLUTION 2008-74
REFUNDING TAX SALE CERTIFICATE #468
THAT WAS REDEEMED
WHEREAS, the property owned by LZJN Properties,
LLC also known as Block 13, Lot 2 located at 77
Belvidere Ave. had unpaid 2006 Taxes and Sewer
Service Charges and was sold at a Tax Sale held
on April 16, 2007 by the Oxford Township Tax
Collector; and
WHEREAS, Crusader Lien Services of 179
Washington Lane, Jenkintown, PA 19046 was the
successful bidder of the above stated property;
and the amount of the Tax Sale consisted of
unpaid taxes, sewer service fees, interests and
other costs, and totaled $7,414.45 and is
represented by Tax Sale Certificate #468; and
WHEREAS, Ronald P. Peles, Esq. paid $16,946.96
via certified check to the Oxford Township Tax
Collector to satisfy the outstanding Tax Sale
Certificate on August 27, 2008 to redeem the
certificate:
NOW, THEREFORE BE IT RESOLVED by the Mayor and
Township Committee of the Township of Oxford on
this 2nd day of September, 2008 that the Chief
Financial Officer be authorized to draw a check
payable to “Crusader Lien Services” in the
amount of $16,946.96 for the redemption of Tax
Sale Certificate #468; and
BE IT FURTHER RESOLVED that the Tax Collector be
directed to return the satisfied Tax Sale
Certificate to Ronald P. Peles, Esq., of 212
Aldin Road, Stewartsville, NJ 08886.
On motion by Mr. Accetturo and seconded by Mrs.
Riley to adopt Resolution 2008-74 Refunding Tax
Sale Certificate #468.
RESOLUTION #2008-75
FORM OF EMERGENCY RESOLUTION – NJS 40A:4-48
WHEREAS, an emergency has arisen with respect to
unforeseen gasoline and street lighting expenses
and, no adequate provision was made in the 2008
budget for the aforesaid purpose mentioned
above; and
WHEREAS, the total amount of the emergency
appropriations created, including the
appropriation to be created by this resolution
is $60,000.00 and three (3) percent of the total
operating appropriations budget for 2008 is
$72.483.00 and
WHEREAS, the foregoing appropriation together
with prior appropriations does not exceed three
(3) percent of the total operating appropriation
in the budget for 2008.
NOW, THERFORE, BE IT RESOLVED that in accordance
with NJS A:4-48 and majority 2/3 of all
governing body member affirmative vote:
1. An emergency appropriation is hereby made for
Gasoline – Other Expenses in the amount of
$20,000.00 and Street Lighting – Other Expenses
in the amount of $40,000.00
2. That said emergency appropriation shall be
provided in full in the 2009 budget, and is
requested to be excluded from CAPS, pursuant to
NJS 40A:4-53.3
That two certified copies of this resolution be
filed with the Director of the Division of Local
Government Services.
On motion by Mr. Accetturo and seconded by Mrs.
Riley to adopt Resolution 2008-75 Emergency
Resolution for $60,000.
ORDINANCE 2008-14
AN ORDINANCE APPROPRIATING $20,000 FROM THE
CAPITAL IMPROVEMENT FUND TO BE USED FOR BUCKLEY
AVENUE ROAD REPAIR.
BE IT ORDAINED by the Township of Oxford, County
of Warren and State of New Jersey as follows:
SECTION 1. It is hereby appropriated the sum of
$20,000.00 from the Capital Improvement Fund to
be used for Buckley Avenue road repair.
SECTION 2. The period of usefulness of said
improvements are within the limitations of the
Local Bond Law, according to the reasonable life
thereof, computed from the date of said
improvement authorized by this Ordinance is five
(5) years.
This Ordinance shall take effect upon final
passage and publication pursuant to law.
(N.J.S.A. 40:69A-181(b)).
Said Ordinance may be read and inspected at any
time at the office of the Township Clerk,
Township of Oxford.
NOTICE is hereby given that the foregoing
Ordinance was introduced for the first reading
at a meeting of the Committee of the Township of
Oxford held on September 2, 2008 and will be
considered for adoption upon second reading at a
Special meeting to be held on September 24, 2008
at 4:00 PM in the Oxford Municipal Building 11
Green Street, Oxford, New Jersey.
On motion by Mrs. Riley and seconded by Mr.
Accetturo to introduce on first reading,
Ordinance 2008-14 To Appropriate $20,000 from
the Capital Improvement Fund to be Used for
Buckley Avenue Road Repair.
Mrs. Riley stated that Oxford has saved
$10,341.21 in recycling costs for the year 2007,
by having the Department of Public Works pick-up
all recyclables in the Township.
Betty Wysocki, Animal Control Officer discussed
raising fees for dog licenses in 2009. All
spayed and neutered dogs will be $10.00 and
unsprayed and unneutered dogs will be $15.00. An
ordinance changing the fees will be introduced
at the next Township meeting on September 17,
2008.
She also discussed charging all cat owners with
a licensing fee. Mrs. Wysocki stated that in
other Townships that have this requirement, the
price of housing the cats at a veterinary clinic
runs approximately $1,000.00 a month. She stated
that if anyone sees a stray cat, to call her and
she will trap them and take them away.
The Committee agreed that at this time, the
Township would not charge residents a licensing
fee for owning cats. The Township would like to
have all cats be up to date on their rabies
shots. There are free rabies clinics on
different Saturdays in all Warren County
Municipalities starting in November. There are
fliers around town announcing the dates and
locations.
On motion by Mrs. Riley and seconded by Mr.
Accetturo to buy a new dog licensing program for
2009 called FRA.
Mrs. Riley said that she has done comparison on
sewer bills with property tax bills and have
found three residents have never paid sewer fees
to date. She will research further and will call
PRMUA and have more information at the next
meeting.
Mrs. Riley said that she received a quote from
Art Groves of a price of $1,300.00, to put a
camera into the sewer pipe on Buckley Avenue and
inject a root killer to kill the tree roots that
are penetrating into the pipe. Mr. Groves stated
that he would guarantee up to 60% of sewer lines
have roots in the sewer pipes. Mr. Accetturo
asked why the Township would need a camera. The
Committee agreed to have Lou Accetturo put the
product (root killer) in the sewer pipe on
Buckley Avenue.
Mr. Accetturo requested that the police director
make a request to the Oxford Police Department,
asking for more details in the monthly report
that is submitted each month. Mr. Accetturo is
requesting a figure of how much overtime was
paid out in each pay period and a breakdown of
each motor vehicle summons-types of incidence
and where it took place-the name of the street.
On motion by Mrs. Riley and seconded by Mr.
Accetturo to approve all the bills on the Bill
List for the month of August.
PUBLIC COMMENT
The Mayor opened the meeting to public for any
comments. There were no public comments.
Mr. Accetturo suggested that a letter be put
together to all business owners downtown that
basically states that the Committee is in the
process of working on the billing issues for
sewer. This letter would invite anyone to make a
comment or share with the Committee or the
Township Engineer any information they have to
assist with the decision how billing should be
charged. Bill Gleba and Rich Motyka will also be
assisting the Committee with these adjustments
on the sewer bill.
On motion by Mrs. Riley and seconded by Mr.
Accetturo to adjourn the meeting at 7:40 PM.
